From 6 April 2018 the Tier 1 (General) category will be closed to applicants who want to apply for ILR using this visa route. You must make your application for ILR before 6 April 2018 for your application for ILR to be considered by the Home Office, UKVI. The Home Office, UKVI may not consider your application for ILR if you apply for ILR as Tier 1 General Migrant on or after 6 April 2018. An application for ILR as Tier 1 General Migrant is made using application form SET (O). An application for ILR as a Tier 1 General Migrant can be made 28 days before completing the 5 years residence requirement.

The time you are in the UK is called continuous residence. You can only be outside the UK for up to 180 days in any 12 months during that time.

The 5 years can include time in the UK on another visa if it was one of the following:

  • Tier 1 (General)
  • Tier 2 (General)
  • Tier 2 (Minister of Religion)
  • Tier 2 (Sportsperson)
  • Highly Skilled Migrant Programme
  • Work Permit
  • Innovator
  • Self-Employed Lawyer
  • Writer, Composer or Artist

The 5 years can include time in the UK on a Tier 2 (Intra-Company Transfer) visa if one of the following apply:

  • the continuous residence includes a period of leave granted under the Tier 2 (Intra-Company Transfer) rules in place before 6 April 2010
  • the continuous residence includes time where you had a work permit granted because you were the subject of an Intra-Company Transfer

ILR Applications As Tier 1 General Migrant And Discrepancies Between Home Office and HMRC Records With Regards To Previous Earnings

The most common reason for refusal of the application for ILR as Tier 1 General Migrant is involving issues with filing of personal tax returns with the HMRC in line with the income previously declared to the Home Office in previous application(s) for leave to remain as Tier 1 (General) Migrant. Depending on the circumstances which led to discrepancy in income declared to Home Office and the HMRC, it may be possible to succeed in such applications.

In some cases where the income of the applicant was from salary and dividends, the filing of personal tax returns may not be even requirement of the HMRC due to the income level being below the tax chargeability and therefore the allegation of dishonesty and deception levelled by the Home Office may not be justified. As such, the refusal of application under paragraph 322 (5) of the Immigration Rules in certain cases may not be legally justified and it may be possible to challenge the refusal of the application successfully.
