If you are living in the UK following a grant of your initial leave to enter or remain as a result of a successful entry clearance application or application for switching into the Tier 1 Exceptional Talent category, you can apply for an extension of your stay from inside the UK. You will need to apply for an extension where your initial grant of leave was less than 5 years which is the qualifying period for applying for Indefinite Leave to Remain (ILR) as a Tier 1 Exceptional Talent.

There is only one stage for extension applications. To be approved you must meet the following criteria:

  • The Designated Competent Body that originally endorsed your stage 1 application has not advised the Home Office that this has been withdrawn; and
  • During your most recent period of leave as a Tier 1 Exceptional Talent, you have earned money in the UK as a result of employment or self-employment in your field of expertise. This is the field for which the Designated Competent Body endorsed you.

When applying for an extension of stay, you need to provide documents as specified by the Home Office Immigration Rules in support of your claim for previous earnings as a Tier 1 Exceptional Talent.
